Broaden Judicial Review…

‘Law Brawl’ (The Advertiser, 28/12/06) highlights the need for an independent legal review commission in SA.
The review of QC appointments should be broadened to investigate how to compel compliance to the rules of court from existing judges and lawyers.
The present practice of lawyers refusing alternative dispute resolution is a huge cost to the community that demonstrates how judges and lawyers work to line their own pockets rather than to serve the community.
The Advertiser reports Mike Rann’s issues with Chief Justice John Doyle.
Mr Doyle denied leave to appeal a judge’s awarding costs where the Supreme Court trial resulted in a gain of less than $4,000 (i.e. over $71,000 short of the point at which the supreme court rules recommended costs are awarded).
On the same occasion Mr Doyle revealed the victim’s new address to the perpetrator of domestic violence against her… ‘Somewhat clubby’ indeed.
I believe a call for submissions from the community would provide ample support for the need for an independent legal review commission with power to instigate judicial accountability.
